1.A   Agartha Company s.r.o., with its registered office at Libušina 496/3 Moravská Ostrava a Přívoz 702 00, ID 05663083, registered at the Regional Court in Ostrava, Section C, Insert 68792 (hereinafter referred to as the "Seller" or "Controller") processes within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Seller" or "Controller") referred to as the "Regulation"), the following personal data:

-         name, surname

-         E-mail address

-         telephone number

-         Address / Registered Office

-         Company registration number / VAT number

2.      The above personal data must be processed for order processing and other performance of the contract, if a purchase contract is concluded between you and the seller. Such processing of personal data is permitted by Article 6 (1) (b) Regulation – processing is necessary for the performance of a contract.

The seller also processes these data for the purpose of recording the contract and possible future exercise and defence of the rights and obligations of the contracting parties. For the above purpose, personal data is stored and processed for a period of 10 years from the implementation of the last part of the performance under the contract, unless another legal regulation requires the retention of contractual documentation for a longer period. Such processing is possible on the basis of Article 6 (1) (c) and (f) of the Regulation – processing is necessary for compliance with a legal obligation and for the purposes of the controller's legitimate interests.

3.      News and other commercial communications may be sent to the buyer's e-mail address or telephone number, this procedure is allowed by Section 7 (3) of Act No. 480/2004 Coll., on Information Society Services, unless the buyer refuses. These communications can be unsubscribed at  any time in any way – for example, by sending an e-mail or clicking on a link in a commercial communication.

4.      The processing of personal data is carried out by the personal data controller. Personal data is not processed for this controller by any processors.

Personal data will not be transferred to third countries outside the EU.

 

5.      The administrator does not have a so-called commissioner. The administrator can be contacted at the email address mbajgar@daycomp.eu

 

6.      The personal data administrator, as the operator  of the www.daycomp.eu website  , uses cookies on this website for the purpose of:

-         measuring website traffic and creating statistics regarding traffic and visitor behaviour on the website;

-         Basic website functionality.

 

-         The collection of cookies for the purpose set out above may be considered as the processing of personal data. Such processing is possible on the basis of a legal reason – the legitimate interest of the controller, and is allowed by Article 6 para. 1 lit. f) of the Regulation.

 

-         The Website can also be used in a mode that does not allow the collection of data on the behaviour of website visitors – this mode can either be set within the browser settings, or it is possible to object to such collection on the basis of the Controller's legitimate interest under Article 21 of the Regulation, which is available at the bottom of the Website. Your objection will be evaluated immediately. Cookies necessary for the functionality of the website will be stored only for the time necessary for the website to function.

-         If the visitor objects to the processing of technical cookies necessary for the functioning of the website, the full functionality and compatibility of the website cannot be guaranteed.

-         Cookies that are collected for the purpose of measuring website traffic and creating statistics regarding traffic and visitor behaviour on the website are assessed in the form of an aggregate and in an anonymous form that does not allow identification of an individual. 

-         The collected cookie files are processed by other processors:

§  Google Analytics service provider, operated by Google Inc., with its registered office at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA;

§  The provider of the newsletter service is operated by MailChimp 405 N Angier Ave. NE Atlanta, GA 30308 USA

 

7.      Please note that under the Regulation you have the right to:

-         cancel the sending of commercial communications at any time,

-         object to processing based on the legitimate interest of the controller,

-         request information from us about what personal data we process,

-         request access to this data from us and have it updated or corrected, or request restriction of processing,

-         require us to delete these personal data, we will delete them unless it is in conflict with valid legal regulations or legitimate interests of the administrator,

-         to data portability, if the processing is automated on the basis of consent or for the performance of a contract,

-         request a copy of the personal data being processed,

-         to an effective judicial remedy if you consider that your rights under the Regulation have been infringed as a result of the processing of your personal data in violation of the Regulation;

-         file a complaint with the Office for Personal Data Protection.
